Acceptance of terms

By downloading, installing, or using SomniSense, you agree to these Terms of Service. If you do not agree, do not use the service. SomniSense is operated by SomniAI LLC, a Wyoming, USA limited liability company.

Service description

SomniSense is a wellness and self-monitoring app that uses on-device AI to classify snore-like audio segments and flag candidate breathing-pattern regions. It is not a medical device, not a diagnostic tool, and not a substitute for clinical evaluation. See our Medical Disclaimer for the full medical scope.

Subscriptions and billing

• SomniSense offers an optional 7-day Pro trial. Free basics remain available without a Pro subscription.
• App-store Pro is $7.99/month or $49.99/year (~$4.17/month, save 48%) and renews until cancelled.
• One-payment Web Passes are also available: $19.90 for 3 months or $89.90 for lifetime access. They do not auto-renew.
• App-store subscriptions are managed through Apple App Store or Google Play. Web Pass checkout and billing management are provided through our secure Stripe-hosted web checkout.
• You can cancel an app-store subscription through your store, or cancel a Web Pass during its trial through the linked Stripe billing portal.
• App-store refunds are processed by Apple / Google. The separate refund terms shown at Web Pass checkout apply to web purchases.

Acceptable use

You agree to:

• Use SomniSense only for personal, non-commercial sleep monitoring
• Not reverse engineer, decompile, or attempt to extract the AI model
• Not use SomniSense for monitoring others without their explicit consent
• Not redistribute or resell the service

Intellectual property

SomniSense and the underlying AI algorithm are proprietary to SomniAI LLC. The breathing-irregularity detection technology builds on years of sleep apnea research by our founder. The current version powering SomniSense was retrained from scratch and rebuilt for SomniAI LLC. Three companion preprints are published openly on Zenodo with DOI records; U.S. provisional patent applications have been filed and are pending.

Limitation of liability

To the maximum extent permitted by law, SomniAI LLC is not liable for any indirect, incidental, special, or consequential damages arising from your use of SomniSense. Our total liability for any claim is limited to the amount you paid in the 12 months preceding the claim.

SomniSense is not a medical device. SomniAI LLC is not responsible for medical decisions made based on app data. Always consult a licensed clinician for medical concerns.

Termination

You can terminate your account anytime via the in-app data management screen or by emailing us. We may terminate or suspend access for violation of these terms, with notice when feasible.

Governing law

These terms are governed by the laws of the State of Wyoming, USA, without regard to conflict of law principles. Any dispute will be resolved in the state or federal courts located in Wyoming.

Changes to terms

We may update these terms and will post the updated date. When feasible, material changes will be communicated through the account email, an in-app notice, or both. Continued use after the effective date of updated terms constitutes acceptance.
